Terms of Service

These Terms of Service ("Terms") govern your use of the lesson scheduling and SMS notification services provided by Knotheads LLC ("Knotheads," "we," "us," or "our"), a Florida limited liability company. By providing your phone number and enrolling in our scheduling system, you agree to these Terms.

1. Services

Knotheads provides kiteboarding instruction and uses an SMS-based scheduling system to notify clients when wind and weather conditions are suitable for lessons. Our service includes:

Weather-triggered SMS notifications when conditions match your availability
Lesson confirmation and booking via SMS
Scheduling management for kiteboarding lessons

2. SMS Messaging Terms

By enrolling in our scheduling system you expressly consent to receive recurring automated SMS text messages from Knotheads at the phone number you provide. These messages include lesson availability alerts, booking confirmations, and scheduling updates.

Message frequency: Varies based on weather conditions, typically 0–2 messages per day during active seasons
Message and data rates may apply depending on your carrier and plan
To opt out: Reply STOP at any time. You will receive one final confirmation message
To opt back in: Reply START at any time
For help: Reply HELP or contact us directly

Consent to receive SMS messages is not a condition of purchasing any services from Knotheads.

3. Lesson Bookings and Cancellations

When you confirm a lesson via SMS, you are reserving a time slot with our instructor. We ask that you provide at least 24 hours notice if you need to cancel. Late cancellations or no-shows may affect your priority in our scheduling queue.

Lessons are subject to weather and safety conditions. Knotheads reserves the right to cancel or reschedule lessons at any time due to unsafe conditions, instructor availability, or other circumstances beyond our control.

4. Safety and Assumption of Risk

Kiteboarding is an inherently risky activity. By participating in lessons with Knotheads, you acknowledge and accept the risks associated with kiteboarding, including but not limited to injury, property damage, and adverse weather conditions. You agree to follow all safety instructions provided by our instructors.

Clients must be in good physical health and able to swim. Knotheads reserves the right to refuse service to anyone we deem unable to safely participate.

5. Payment

Payment terms will be provided at the time of booking. Knotheads reserves the right to update pricing at any time. Confirmed lesson fees are due as specified at the time of booking.

6. Limitation of Liability

To the fullest extent permitted by Florida law, Knotheads LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services or participation in kiteboarding lessons. Our total liability to you shall not exceed the amount paid for the specific lesson in dispute.

7. Privacy

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Changes to These Terms

We may update these Terms from time to time. Continued use of our services after changes constitutes acceptance of the updated Terms. We will notify active clients of material changes via SMS or email.

9. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Florida.
